What each section does, and how they differ.

Sec. 1 Purpose

Establishes procedure preventing cumulative stacking of tariffs on same articles from multiple executive actions.

Sec. 2 Applicability

Order applies to tariffs from Proclamation 10908 (autos), EO 14193/14226 (northern border), EO 14194/14227 (southern border), Proclamations 9704/9705 (aluminum/steel).

Sec. 3 Non-Stacking of Tariff Measures

Tariffs apply hierarchically: articles subject to auto tariffs excluded from border tariffs; border tariffs excluded from metal tariffs; aluminum and steel tariffs cumulative.

Sec. 4 Non-applicability to Other Tariff Measures

Order does not affect other applicable duties, tariffs, or charges including HTSUS rates, Section 301 tariffs, or antidumping duties.

Sec. 5 Implementation

Homeland Security to update guidance and systems within 180 days; HTSUS changes effective May 16, 2025, applying retroactively to March 4, 2025 entries.

Sec. 6 General Provisions

Standard boilerplate: preserves existing agency authority, conditions the order on appropriations, and creates no enforceable private rights.
