Sec. 1 Purpose

Amends Executive Order 13603 to adjust delegations of Defense Production Act authorities and clarifies provisions regarding when agency recommendations to the President are required.

Sec. 2 Amendment to Executive Order 13603

Modifies section 203 to allow both Commerce Secretary and Energy Secretary to exercise delegated authority independently of each other.

Sec. 3 Clarifying Section 2(a) of Executive Order 14156

Establishes that agency heads need only recommend presidential action when the authority is vested in the President alone and has not been delegated; clarifies that agency delegations under prior executive orders obviate recommendations.

Sec. 4 General Provisions

Standard boilerplate: preserves existing agency authority, conditions the order on appropriations, and creates no enforceable private rights.
