Oregon's states challenge the Section 301 tariffs

Twenty-five states, led by Oregon, sued in the U.S. Court of International Trade on August 3, 2026 (No. 1:26-cv-03467) to challenge the U.S. Trade Representative's July 23 notice imposing worldwide tariffs of 10 and 12.5 percent under Section 301 of the Trade Act of 1974. The states call it the administration's third tariff theory, after the IEEPA reciprocal tariffs the Supreme Court struck down in February 2026 and the Section 122 surcharge, and argue in part that the Section 301 tariffs are ultra vires. They requested a three-judge panel. The government entered the case on August 4 (DOJ appearance plus scheduling and case-management motions); the answer is due October 2.
