Case Overview
An attorney disciplinary proceeding against Assistant U.S. Attorney Kevin Bolan in the District of Rhode Island. The proceeding grew out of Bolan's handling of the government's response in Gomez v. Nessinger, 1:26-cv-00245, an immigration habeas case before Judge Melissa R. DuBose. The government filed what Judge DuBose described as the same response it had filed in similar cases, containing no facts about this petitioner and nothing bearing on dangerousness, criminal history or risk of flight. She granted habeas and ordered Bryan Rafael Gomez released pending a bond hearing. DHS then publicly condemned her using a Dominican Republic homicide warrant that had not been placed before her court.
Chief Judge John J. McConnell Jr. opened the disciplinary proceeding under District of Rhode Island Local Rule Gen 210(b)(2) and appointed Roger Williams University law professor Niki Kuckes as special counsel to investigate.

The Conclusion
Special counsel reported on June 16, 2026 that there was sufficient evidence Bolan violated his duty of candor to the court by failing to disclose the homicide warrant before the release decision, while recommending against formal discipline. The court sent Bolan a letter the same day. The docket remains open and the proceeding is not terminated.
