State of Illinois v. Federal Emergency Management Agency
No. 1:26-cv-00485 District · Active
Case Overview
A coalition of 24 attorneys general (23 states and the District of Columbia), led by Illinois, plus the governors of Kentucky and Pennsylvania, sued FEMA, DHS and Acting Administrator Robert J. Fenton over new conditions the administration attached to FEMA grant funds. The states allege the conditions, which reach into elections and immigration enforcement, are imposed without statutory authority and violate the APA and the Spending Clause.
The Conclusion
Filed 2026-07-23 in the District of Rhode Island before Judge Mary S. McElroy. The coalition seeks to block the grant conditions as ultra vires agency action.
